These Terms of Service ("Terms") form a binding agreement between you (and the business you represent — "you," "Client") and RG Loomis LLC. You represent that you are at least 18, have authority to bind your business, and will comply with all applicable laws. By signing up for, paying for, or using the Service in any way, you accept these Terms in full.
iBlueText provides hosted iMessage and SMS messaging, iPhone/iMessage number lookup, SMS/phone verification ("SMS Verify") via a drop-in widget and REST API, optional AI replies, contact/consent record-keeping, and related tools. Features, limits, and pricing are described on our pricing and docs pages and may change. SMS Verify helps you collect and document opt-in consent so you can build a TCPA-compliant, consented contact list — but you remain responsible for your own compliance as set out below.
You are solely responsible for the messages you send and the contacts you message, upload, or verify. You agree that you will not:
You represent and warrant that you have a lawful basis and all necessary consents for every contact you message or verify through iBlueText.
If you send marketing or promotional messages, you must only send them between 8:00 a.m. and 9:00 p.m. in the recipient's local time, and you must comply with any stricter state, local, TSR, or carrier requirements. iBlueText may offer an optional quiet-hours control that defers marketing sends to the recipient's local window based on area code; that control is a convenience, is not guaranteed to be accurate, and does not relieve you of your independent legal obligation to comply with calling-time and consent laws. Transactional messages you are legally permitted to send (such as one-time verification codes the recipient requested, and replies within an active two-way conversation the recipient initiated) are not subject to the marketing quiet-hours window. You — not RG Loomis — are the "sender" for legal purposes and are solely responsible for compliance, fines, and penalties.
When an end user verifies a phone number through our widget or API, that user is presented with consent language and, by proceeding, consents to be contacted by SMS, text, and iMessage by RG Loomis LLC, iBlueText, the originating app or website (our Client), and the partners, affiliates, associated companies, and subsidiaries of each of the foregoing. You must display accurate consent language and links to your own privacy policy and terms.
Data ownership. Phone numbers, names, emails, and consent records collected through the Service are the property of both the originating website/app owner (our Client) and RG Loomis LLC, who may each use them as permitted by these Terms and the Privacy Policy. We do not sell personal data to third parties. You may export your contacts at any time and are responsible for handling that data lawfully once exported.
You must provide accurate information, keep your password, API keys, site keys, and secrets secure, and you are responsible for all activity under your account and keys. You must verify your phone number to use the Service. One account per person/business unless we agree otherwise.
Paid plans, lines, and credits are billed in advance and automatically recur until canceled. You authorize us (via Stripe) to charge your payment method on each renewal. Fees are exclusive of taxes. We may change pricing on notice.
ALL FEES ARE FINAL AND NON-REFUNDABLE. WE DO NOT GIVE REFUNDS OR CREDITS OF ANY KIND, FOR ANY REASON. This includes, without limitation: one-time setup and activation fees; hosted phone line, number, and iMessage account activation; monthly and annual subscription fees (for the current and all prior periods); prepaid lookup credits; prepaid verification credits; and any partial, unused, or remaining portion of any plan, line, or credit balance. When you purchase a line or hosted service, we incur immediate, non-recoverable costs to provision a physical phone, Mac, number, and iMessage account on your behalf — that money is spent and cannot be returned to us, and is therefore not refundable to you.
Cancellation stops future renewals only. Canceling does not entitle you to any refund, proration, or credit for the current billing period or any prior period; your access continues until the end of the period you already paid for, after which it ends.
Blocked or deactivated hosted lines — replacement, not refund. If a phone line, number, or iMessage account that we host for you is blocked, rate-limited, or deactivated by a carrier or by Apple through no fault of your own, we may, at our sole discretion, replace it with a new line and iMessage account at no additional charge. This free replacement is your sole and exclusive remedy; no refund or credit is owed for any blocked, deactivated, paused, or interrupted line. We owe no replacement and no refund where the block, deactivation, or suspension results from your conduct — including spam, unsolicited messaging, or any violation of the TCPA, TSR, CAN-SPAM, CTIA, carrier rules, Apple policies, applicable law, or these Terms.
No refunds on enforcement. If we suspend or terminate your account for abuse or any violation of these Terms or our Acceptable Use Policy, you forfeit all fees paid and all remaining credits and plan time, with no refund. Chargebacks & disputes: initiating a chargeback or payment dispute for services we have provided is a breach of these Terms; we may immediately suspend your account and pursue the disputed amounts plus costs.
We may monitor for abuse and may suspend or terminate accounts that violate these Terms, with or without notice and without refund, and may share information with carriers, Apple, payment processors, or authorities in response to abuse or legal process.
Message and code delivery depends on carriers, Apple, devices, and factors outside our control and is not guaranteed. The Service may be unavailable, delayed, throttled, or interrupted. We do not warrant that any message, lookup, or verification will be delivered, accurate, or timely.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or that lookups or verifications will be correct.
You agree to defend, indemnify, and hold harmless RG Loomis LLC, iBlueText, and their owners, members, managers, officers, employees, agents, partners, affiliates, and subsidiaries (the "Indemnified Parties") from and against any and all claims, demands, suits, actions, investigations, losses, liabilities, damages, fines, penalties, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your messages, calls, campaigns, or use of the Service; (b) your contacts, lists, or consent practices; (c) your violation of the TCPA, TSR, CAN-SPAM, CTIA, carrier rules, Apple terms, or any law; (d) your violation of these Terms; or (e) your violation of any third party's rights. This obligation survives termination.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE INDEMNIFIED PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY. IN ALL CASES, THE INDEMNIFIED PARTIES' TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some may not apply to you.
You acknowledge that messaging carries legal risk and that you are using the Service at your own risk. You are the party responsible for obtaining consent, honoring opt-outs, observing calling times, and complying with all laws. Any fines, penalties, or claims arising from your messaging are your responsibility alone.
PLEASE READ — THIS AFFECTS YOUR RIGHTS. You and RG Loomis LLC agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms (a "Dispute") will be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Florida, and not in any court, except that either party may bring an individual claim in small-claims court.
You and RG Loomis each waive the right to a trial by jury and the right to participate in a class action, collective action, or representative proceeding. Disputes will be arbitrated only on an individual basis; the arbitrator may not consolidate or preside over claims of more than one person. You agree not to sue RG Loomis in court and that arbitration is the sole and exclusive forum for Disputes. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court, with the jury-trial waiver still applying.
You may cancel anytime. We may suspend or terminate the Service for any violation of these Terms, non-payment, or risk to the Service or others. Sections that by their nature should survive (including 5, 10–14) survive termination.
We may update these Terms; the "last updated" date will change and continued use means acceptance. Material changes may be communicated by email or in-app.
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. Subject to Section 14, any matter not subject to arbitration will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
